IVF RULES IN INDIA
Surrogacy and egg donation laws in India
India changed its laws on surrogacy and assisted reproduction in 2021. This page explains, in plain terms, what international patients can and cannot do. Orvica does not arrange surrogacy.
Medical recommendations come from your qualified treating clinicians.
Surrogacy in India
The Surrogacy (Regulation) Act, 2021 bans commercial surrogacy and allows only altruistic surrogacy for eligible Indian couples and certain Indian women. Foreign nationals cannot commission surrogacy in India, and Orvica does not arrange it.
IVF and the ART Act
The Assisted Reproductive Technology (Regulation) Act, 2021 regulates IVF clinics and banks. It sets age limits for treatment (generally 21 to 50 for women and 21 to 55 for men), requires clinics to be registered, and sets rules for consent, embryo transfer and record-keeping. International couples can have IVF in India within these rules.
Egg and sperm donation
Donor eggs and sperm are allowed under the ART Act through registered banks, with strict conditions on who can donate and how often. Donors are anonymous. Your clinic tells you whether donor treatment is available for your situation.
Why the rules matter to you
Choose a registered clinic, and be cautious of anyone offering surrogacy or paid donation for foreigners in India: it is not legal. Laws can change, so your clinic confirms the current rules before treatment.
